on demand, equipment for demolition programmes as well as manpower for carrying out demolitions, at the quoted/ awarded rates, which have been described in schedule of rates here to.3 the engineer-in-charge shall be the competent authority to take a decision for forfeiting the security deposit or any part thereof, because of non-compliance of any instructions/orders issued by him. 4 that the agency shall, simultaneously after signing of the agreement, submit a certificate along with agreement with equipment supplier if any to the engineer-in-charge that all demolitions items, equipments as well as manpower whenever required for the demolitions shall be kept readily available at shortest time gap and the contractor shall be informed about the demolition programme either through letter, telephonically, whatsapp, e-mail or by any other means.5 it is specifically agreed that in case of any failure/ non-compliance on the part of the agency, in respect of the supply of any equipments, manpower, the engineer-in-charge shall be entitled to arrange requisite demolition equipments, and manpower at the risk and cost of the agency. it is further specifically agreed that any loss or damages suffered by the authority because of any non-fulfilment of the agencies obligations under the agreement or violations of the terms and conditions of the agreement by the agencyshall be recovered from the agency. 6 that while making payments, the authority shall abide by all the fiscal legislation including deduction of tax at source as applicable, as per prevalent government orders. 7 that the agency shall carry the demolition items, equipments, instruments and manpower required for carrying out the same to the site of demolition at its own expenses. nothing extra shall be payable by the authority to the agency in this behalf. 8 that the labour/ manpower employed by the agency shall always be employees of the agency and under no circumstances the authority shall have to do anything with the labour/ manpower. any injury caused to the manpower, or damage to the demolitions items/ equipments/ instruments shall be the sole and exclusive responsibility of the agency9 that the agency is required to carry out an insurance of all its demolition items/equipments and instruments which shall cover the third party claim also. further the agency is required to get itself insurance protection in respect of any injury to the labour/manpower employed by the agency for the purpose of carrying out any requisite demolition. it is specifically agreed that any claim on the insurance company in respect of any damage to the demolition items/ equipments/ instruments or claim in respect of any injury to the labour employed, shall be borne by the agency exclusively and the authority shall have no concern with the same. the demolition equipments wherever required to be operated manually, shall be operated by persons employed by the agency and the authority shall have no concern in respect of the terms or incidents of employment of such persons. 10 recovery at double the agreement /accepted rate or market rate whichever is more per machinery/per day shall be made if agency fails to provide requisite machinery tools & manpower on the day of demolition programme. 20 12 in case any equipment or machinery becomes unserviceable, during the execution of demolition programme, the rates/ reduced rates be paid to the agency as per the recommendations of the engineer-in-charge. 13 executive engineer ensure that all the dismantled material received during the course of demolition at site will be the property of dda and same shall be kept in record & will be auctioned in open market to bear the cost of demolition.any recoverable or reusable material (e.g., doors, windows, steel, bricks) shall be listed, stored, and handed over to dda officials or disposed of as per written directions14 the contractor shall provide personnel safety equipment to all the manpower engaged on work. 15 all labours will be wearing reflective jackets of same colour. 16 agency will carry out photography & videography of all demolition carried out. in absence of videography & photography, no payment will be made to agency.17 agency may be asked to carryout up to three programmes in a day depending on job requirements as decided by engineer-in-charge. in case of failure to supply equipment and manpower etc., punitive action shall be taken under relevant terms and conditions described above.18 all demolition work must comply with local/state/national safety regulations (e.g., osha, is codes, etc.). the contractor shall be responsible for providing all personal protective equipment (ppe) to their workforce.19 adequate measures must be taken to control dust, noise, and vibrations. water spraying and sound barriers should be used where necessary.20 the contractor shall strictly adhere to all relevant guidelines, circulars, and standard operating procedures (sops) issued by the dda related to demolition works and environmental management21 the contractor must coordinate with relevant dda departments such as land management, engineering wing, and horticulture (if applicable) during the execution.22 after demolition, the site must be restored and leveled as per dda’s instructions. temporary structures, debris, and waste materials must be fully removed.23 the employer reserves the right to terminate the contract for unsatisfactory performance or violation of any terms.
